Milwaukee Slip and Fall Lawyer

A fall can change everything in a second. One moment you are grabbing groceries or leaving a Bucks game, and the next you are on the ground with a broken hip, a concussion, or a back injury that will not go away. If your fall happened because a property owner ignored a hazard, you should not be the one paying for it. You need a Milwaukee slip and fall lawyer who gets to work before the evidence disappears.

Wisconsin property owners have a legal duty to keep their premises reasonably safe, and many are held to an even higher standard under state law. When they fail and someone gets hurt, Badger Injury Law digs in and does not let go.

Why Choose Badger Injury Law for Your Slip and Fall Case?

Slip and fall claims look simple from the outside. They are not. Property owners deny everything, insurers shift blame onto the injured person, and both count on you giving up. Here is what changes when the Badger is in your corner.

A Milwaukee Slip and Fall Attorney Who Moves Fast

Evidence in these cases has a short shelf life. Camera footage gets overwritten, spills get mopped, and ice melts by morning. We start the investigation immediately and send preservation demands before the property owner's version of events becomes the only version left.

Deep Knowledge of Wisconsin Premises Liability Law

Premises liability is the area of law covering injuries on someone else's property, and Wisconsin's rules are different from most states. That includes a Safe Place Statute that holds many property owners to a higher standard of care. We know these laws inside and out, and we use them to build pressure.

Trial-Ready Representation Insurers Respect

Insurance companies keep track of which lawyers prepare cases for trial and which ones settle cheap to close files. We build every claim as if it is going in front of a Milwaukee County jury. That changes the conversation from day one.

Property Owners Move Fast After a Fall. The Badger Moves Faster.

When you fall in a store, a tavern, or an apartment building, the clock starts immediately, and it is not running in your favor. Businesses and their insurers often:

  • File internal incident reports written to protect the company, not you
  • Clean up, repair, or salt over the hazard before anyone documents it
  • Overwrite security camera footage, sometimes within days
  • Push you for a recorded statement while you are still hurting

Our job is to beat them to the evidence. We send preservation letters for surveillance video, pull maintenance and inspection logs, photograph the scene, interview witnesses, and lock down the facts before they can be swept away.

The earlier you call, the stronger your case.

Where Slip and Fall Accidents Happen in Milwaukee

Milwaukee is a city of grocery runs, tavern nights, packed arenas, and long winters. Falls happen anywhere people gather, and we handle cases across all of it.

Grocery Stores and Supermarkets

Stores like Pick 'n Save, Metro Market, Woodman's, and Costco move thousands of shoppers through their aisles every day. Common hazards include unattended spills, leaking coolers and freezer cases, crushed produce on the floor, and entryways slick with tracked-in snow and rain.

Shopping Malls and Retail Centers

High-traffic destinations like Mayfair and Bayshore see constant wear. Wet entrance tile, uneven flooring transitions, stairway and escalator hazards, and neglected parking areas put shoppers at risk year round.

Bars, Taverns, and Restaurants

Milwaukee's tavern culture is part of what makes this city great. It also means spilled drinks, dim lighting, crowded floors, and icy steps and patios outside the door. Owners are still responsible for keeping those spaces safe for the people they invite in.

Stadiums, Arenas, and Event Venues

Fiserv Forum, American Family Field, and the Summerfest grounds pack in enormous crowds. Spilled beverages on concourses, slick ramps and stairs, and congested walkways lead to serious falls, and large venues are often held to Wisconsin's higher safe place standard.

Apartment Buildings and Rental Properties

Landlords must keep common areas safe for tenants and guests. We regularly see broken stairs and handrails, burned-out lighting in hallways and stairwells, cracked walkways, and snow and ice left on steps and entrances for days.

Parking Lots and Parking Structures

Potholes, crumbling concrete, poor lighting, and black ice make parking areas one of the most common places Milwaukeeans get hurt.

Public Sidewalks and Government Property

Falls connected to public property follow different rules and much tighter deadlines than a typical injury claim. If a government entity might be involved in your fall, talk to a lawyer right away. We cover those deadlines below.

Winter Slip and Fall Accidents in Milwaukee: Ice, Snow, and Sidewalks

Nobody has to explain a Milwaukee winter to you. Snow piles up, daytime melt refreezes overnight, and by February, sidewalks and parking lots can turn into sheets of black ice. That freeze and thaw cycle drives a wave of serious falls every year, and older adults are hit hardest.

Here is what property owners do not want you to know: winter is not an excuse. In Wisconsin, snow and ice are foreseeable, and businesses and landlords are expected to plan for them. That includes:

  • Clearing and salting walkways, steps, and parking lots within a reasonable time
  • Putting down mats and warning signs where slush gets tracked inside entrances
  • Fixing downspouts and drainage that dump water across walkways where it refreezes
  • Following the City of Milwaukee ordinance that requires sidewalks to be cleared of snow and ice within 24 hours after snowfall ends

When an owner ignores an ice hazard for days, or lets the same stretch of pavement refreeze all season, that is negligence. We use weather records, maintenance logs, and prior complaints to prove how long the danger existed and exactly who should have fixed it.

Wisconsin Slip and Fall Law: What You Have to Prove

To win a slip and fall case in Wisconsin, you generally have to show four things:

  1. The property owner owed you a duty of care. In most cases, that duty applies when you were lawfully on the property.
  2. They breached that duty. They knew about the hazard, or should have discovered it through reasonable inspection, and failed to fix it or warn you.
  3. That failure caused your fall.
  4. You suffered real damages, such as medical bills, lost income, and pain.

Most of the fight happens on the second point. Owners claim they had no idea the hazard existed. That is where proof of how long the spill sat, how long the ice built up, and how often anyone actually inspected the area wins cases. It is also where Wisconsin hands injured people a powerful extra tool.

What to Do After a Slip and Fall in Milwaukee

1

Get medical attention first. Some fall injuries, especially head, neck, and back injuries, take hours or days to fully show themselves. See a doctor even if you feel okay.

2

Report the fall. Tell the manager, landlord, or property owner what happened and ask for a copy of the incident report. Stick to the facts and do not sign anything else.

3

Document everything. Photograph the hazard before it is cleaned, repaired, or melted. Capture your injuries and footwear, and collect names and phone numbers of witnesses.

4

Say less to insurers. Do not give a recorded statement or accept a quick settlement before you talk to a lawyer.

The Wisconsin Safe Place Statute: A Higher Standard of Care

Wisconsin has a law most states do not. The Safe Place Statute, Wis. Stat. § 101.11, requires owners of public buildings and places of employment to keep their premises as safe as the nature of the place reasonably permits. That is a higher bar than ordinary negligence, which asks only for reasonable care.

Here is what that means for your case:

  • It covers most of the places people actually fall, including stores, restaurants, taverns, arenas, offices, and other buildings open to the public
  • Owners have a duty to actively inspect for hazards, not just react to the ones they happen to notice
  • If a reasonable inspection would have uncovered the danger, “we did not know” is not a defense

Plenty of firms bury the Safe Place Statute in legal jargon or never mention it at all. We build cases around it. When it applies, it raises the standard your case is judged by and puts the property owner on the defensive, which is exactly where the Badger wants them.

Wisconsin Comparative Negligence: Partial Fault Does Not End Your Case

Insurance adjusters love to blame the person who fell. You should have watched where you were going. The hazard was obvious. Do not let that talk scare you away from your claim.

Wisconsin follows a modified comparative negligence rule under Wis. Stat. § 895.045. You can still recover compensation as long as you were not more at fault than the property owner or other responsible party. In practice, if you are found 50 percent or less at fault, your case survives, and your compensation is simply reduced by your share of the blame.

Here is how the math works:

  • You are awarded $100,000
  • The jury finds you 20 percent at fault
  • You recover $80,000

Adjusters push your fault percentage up because every point they add saves them money. We push back with evidence, and we do not let an insurer turn your injury into your fault.

How Long Do You Have to Sue for a Slip and Fall in Wisconsin?

In most cases, Wisconsin gives you three years from the date of your injury to file a personal injury lawsuit. That deadline comes from Wis. Stat. § 893.54.

Three years sounds like plenty of time. It is not:

  • Surveillance footage is often overwritten within days or weeks
  • Witnesses move away and memories fade
  • The hazard gets repaired, repaved, or salted over
  • In winter cases, the ice that caused your fall can be gone by the afternoon

There is also a trap that catches people every year. If your claim involves a government entity, such as a fall connected to city property, Wisconsin generally requires a written notice of claim within 120 days under Wis. Stat. § 893.80. Miss that notice and you can lose the claim entirely, no matter how strong it is.

The safest move is simple. Talk to a lawyer now, while the evidence still exists.

What Compensation Can You Recover After a Milwaukee Slip and Fall?

Suing for a slip and fall is not about a payday. It is about not paying, out of your own pocket, for an injury someone else caused. Depending on your case, compensation may include:

  • Medical expenses, from the ambulance ride through surgery, rehabilitation, and future care
  • Lost wages while you recover
  • Reduced earning capacity if your injuries keep you from returning to your old work
  • Pain and suffering
  • Loss of enjoyment of life, including the hobbies and independence your injury took from you
  • Damages available to surviving family members in fatal fall cases

Every case is different, and no lawyer can promise a specific outcome. What we promise is this: we will pursue every dollar your case supports, and we will not let an insurer shortchange you.

Frequently Asked Questions

  • How long do I have to file a slip and fall lawsuit in Wisconsin?

In most cases, you have three years from the date of your injury under Wis. Stat. § 893.54. If a government entity is involved, such as a fall connected to public property, you generally must serve a written notice of claim within 120 days under Wis. Stat. § 893.80. Evidence disappears far faster than any deadline, so it pays to act right away.

  • What do I need to prove in a Wisconsin slip and fall case?

You need to show the property owner owed you a duty of care, that they knew or reasonably should have known about the hazard and failed to fix it or warn you, and that the fall caused your damages. In many cases involving stores, taverns, arenas, and other public buildings, Wisconsin's Safe Place Statute holds the owner to an even higher standard, which can strengthen your claim.

  • Can I still recover compensation if I was partly at fault for my fall?

Yes. Under Wisconsin's comparative negligence law, Wis. Stat. § 895.045, you can recover as long as you were not more at fault than the property owner, and your compensation is reduced by your percentage of fault. Insurers work hard to inflate that percentage, which is exactly why strong evidence matters.

  • Who is responsible if I slip on ice or snow in Milwaukee?

It depends on where you fell. Wisconsin businesses and landlords must treat snow and ice as the foreseeable hazards they are, which means clearing, salting, and maintaining their walkways and lots within a reasonable time. Milwaukee also requires property owners to clear the sidewalks bordering their property within 24 hours after snow stops falling. Falls on government property follow different rules and shorter deadlines, so speak with a lawyer quickly.

  • What is a Milwaukee slip and fall case worth?

There is no formula. The value depends on the severity of your injuries, your medical bills and future care needs, lost income, and how the injury changes your daily life. Serious falls involving hip fractures, spinal damage, or brain injuries often support substantial claims. We evaluate your case for free and give you an honest assessment, never an inflated promise. Results may vary, and no outcome can be guaranteed.
